1. Acceptance of Terms

By downloading, accessing, or using CitrusLearn ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

2. Description of Service

CitrusLearn is a free language-learning application that helps users study Mandarin Chinese through interactive quizzes, spaced repetition, and AI-powered speech features. The App is available on iOS and may be expanded to other platforms in the future.

3. Eligibility

CitrusLearn is available to users of all ages. If you are under 13 (or under 16 in the EU), you may only use the App with the consent of a parent or legal guardian. By using the App on behalf of a minor, the parent or guardian accepts these Terms and assumes responsibility for the minor's use of the App. See our Privacy Policy for more details on children's privacy.

4. User Accounts

You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to update it as needed.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Create multiple accounts for abusive purposes
• Use automated systems or bots to access the App

6. Intellectual Property

All content, design, and code within CitrusLearn — including but not limited to text, graphics, logos, audio, and software — are the property of CitrusLearn or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without prior written permission.

7. User-Generated Content

Any vocabulary lists or learning data you create within the App remain yours. By using the App, you grant CitrusLearn a limited, non-exclusive license to process this data solely to provide and improve the service. This license ends when you delete your account.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. CitrusLearn is an educational tool and does not guarantee specific learning outcomes.

9. Limitation of Liability

To the fullest extent permitted by law, CitrusLearn and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App (which is zero for the free version). Nothing in these Terms excludes or limits liability for matters that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold harmless CitrusLearn and its developers from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the App.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may also delete your account at any time. Upon termination, your right to use the App ceases immediately.

12. Dispute Resolution

If you have a dispute regarding the App or these Terms, please contact us first at support@citruslearn.com so we can attempt to resolve the matter informally. If we are unable to reach a resolution within 30 days, either party may pursue formal proceedings under the governing law specified below.

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes through the App or by other reasonable means. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes shall be submitted to the competent courts in the Netherlands. If you are an EU consumer, you retain the right to bring proceedings in the courts of your country of residence.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Apple App Store — Additional Terms

The following additional terms apply when you download or use the App through the Apple App Store:

a. Acknowledgement

You acknowledge that these Terms are concluded between you and CitrusLearn only, and not with Apple Inc. ("Apple"). CitrusLearn, not Apple, is solely responsible for the App and its content. These Terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.

b. Scope of License

The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

c. Maintenance and Support

CitrusLearn is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

d. Warranty

CitrusLearn is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are CitrusLearn's sole responsibility.

e. Product Claims

You acknowledge that CitrusLearn, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms do not limit CitrusLearn's liability to you beyond what is permitted by applicable law.

f. Intellectual Property Claims

You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, CitrusLearn, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

g. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

h. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App. For example, you must not be in violation of your wireless data service agreement when using the App.

i. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
